Minority family land grabbing allegations

Patuakhali Police Superintendent Md. Anwar Zahid has been accused of grabbing land worth Tk 20 crore from a minority family in Patuakhali and selling it for a position.

In this regard, the victim, Babita Mukherjee, wife of the deceased Gautam Mukherjee of the Kalaskathi Zamindar Bari in Bakerganj Upazila, submitted a written complaint to the Chief Advisor of the Interim Government by post on March 16.

The complaint states that although the court had issued a status quo order on the said land, the accused have defied it and are building wooden and tin stalls on the land by pouring bricks and sand and taking advance money. Not getting any remedy, the victim has sent a written complaint to the Chief Advisor along with a copy to the concerned department to get the heirs to understand the rights and possession.

The accused are Patuakhali District Police Superintendent Md. Anwar Zahid, Patuakhali Sadar Police Station Officer-in-Charge Imtiaz Ahmed, Patuakhali Police Superintendent’s SI Kamrul, Patuakhali Sadar Police Station Road area resident Md. Hemayet Hossain Khandaker’s two sons Shakhawat Hossain Khandaker and Tariqul Hasan and Sultan Majlish, son of the deceased Mohammad Majlish, along with 40/50 unidentified local land grabbers.

The complaint filed with the Chief Advisor states that Patuakhali Sadar Police Station’s Jail No. 38, Hal Dag 5046, land area 1 acre 27 percent. In its HalSA 1 Khatian, part eight anna, 63.50 percent Bakri SA 1807, Dag No. 5046 of 1811 Khatian and part eight anna, 63.50 percent of the land is owned by the landowner. The record of which is in the name of Rajeshwar Roy Chowdhury. According to the inheritance law, the owners of this 63.50 percent land are the squatters Pritam Mukherjee, Apu Mukherjee and Tapu Mukherjee. Their parents are the deceased Gautam Mukherjee and Babita Mukherjee.

 

According to court sources, Gautam Mukherjee died on January 27, 2014, leaving behind his three minor children and wife. In such a situation, Babita Mukherjee filed a lawsuit (No. 142/14) in the Barisal Assistant Judge’s Court in favor of 63.50 percent land and other mouzas, totaling 123 acres and 0.250 percent land, seeking guardianship power over the property. Babita Mukherjee received a guardianship certificate from the court on March 9, 2015. On August 9, 2015, she filed a property sale permission lawsuit (No. 27/15) in the same court in favor of guardianship power, and the judge allowed her to sell the property.

It is known from the complaint that in one spot, 63.50 percent of the 1 acre 27 percent land is owned by the owner. Since 63.50 percent of the 1 acre 27 percent land is owned by the owner, Babita Mukherjee applied to the Patuakhali District Commissioner for land distribution, but when she did not get a solution, Babita Mukherjee and her children filed a land distribution lawsuit in court on behalf of the Patuakhali government against the Deputy Commissioner, Superintendent of Police, OC of Sadar Police Station and Executive Engineer of Patuakhali Public Works Department. On August 5, 2019, this case (188/19) was filed in the Patuakhali Joint District Judge 1st Court. Currently, the case is under trial in the 3rd Joint District Judge Court as transferred and filed with the court as De: Md: No. (1/22).

In the said lawsuit, the judge of the court ordered a status quo until a bilateral hearing is held on the land disputed by the defendants. Which is valid and in force. But the defendants knowingly disobeyed the judge’s order and on November 24, 2024, they ordered the accused SI Kamrul to enter the disputed land by providing shelter, building about 50 wooden and tin stalls with bricks, sand and collecting advance money from some locals. When the applicant and his children resisted, the property grabbers drove them away.

Victim Babita Mukherjee said, “I have not received any remedy for forcibly grabbing the land by disobeying the court’s verdict. I have filed a complaint with the Chief Advisor to get a fair and just trial. The property of the helpless Hindu family worth 20 crores should be properly investigated and the illegal structures, shops and houses should be removed so that we can understand the land grab.”

Regarding the land grab of the Hindu family, the accused local Md. Hemayet Hossain Khandaker’s two sons, Shakhawat Hossain Khandaker alias Sabuj, said that he is a monthly tenant of the police administration. Talk to the SP regarding the land grab.

Regarding the land grab in violation of the court order, SI Kamrul said, “As far as I know, this property was previously donated to the police. According to the donation documents, the police also own some of the land. When asked for documentary evidence, he could not give a satisfactory answer.

Patuakhali Deputy Commissioner Abu Hasnat Mohammad Arefin said on his mobile phone, “I have heard about the matter. However, the DC office has no involvement in this incident. As far as I know, no one has applied to the DC office regarding any matter related to the incident.”

Patuakhali District Superintendent of Police Md. Anwar Zahid said on his mobile phone, “He knows nothing about the incident.”
