Alleged torture of UP Chairman Court case against police

A case has been filed in Brahmanbaria District and Sessions Judge Court against Sarail Thana Police District and Detective Police on the allegation of physical torture against a UP Chairman of Brahmanbaria’s Sarail Upazila. Mostafizur Rahman, the persecuted UP Chairman of Panishwar Union of Sarail Upazila, filed this case yesterday morning as the plaintiff. District and Sessions Judge Esharmin Nigar accepted the case and reserved it to issue an order after the hearing. Later in the afternoon, he fixed the next date of 15 March  for the order of the case. The accused in this case, registered under Section 15(1) of Torture and Custodial Death (Prevention) Act, 2013, are Sarail Thana Inspector (Investigation) Sarail Thana Inspector Md. Shehabur Rahman, Deputy Inspector (SI) Md. Joynal Abedin, Deputy Inspector Pankaj Das, Assistant Deputy Inspector Dilip Kumar Nath and one Deputy Inspector of District Intelligence Department and 10/12 unidentified policemen of Sarail Police Station and DB. UP Chairman Mostafizur Rahman claimed in the case RG that on February 2, when a tense situation arose between the people of Sitaharan village, Md. Harish Mia and Solaiman Mia, he informed the officer-in-charge of Sarail police station over the phone, saying that he was on leave and asked the inspector to contact the investigation.

UP Chairman later contacted several senior officials of Sarail Thana Police along with several senior officials of the district police on telephone and the concerned assured to take action. Meanwhile, he kept in touch with the local dignitaries to settle the disputes between the two parties. In the details of the case, the UP Chairman claimed that the UP Chairman gave the first call to S.I. Shankar Das (case No. 3) when the conflicting parties clashed the next day, i.e. on the afternoon of February 3. Meanwhile, the officer-in-charge of Sarail police station called the chairman and told him that he is sending the force and he (UP chairman) should handle the situation with the dignitaries. Later Sarail Thana Police and District Intelligence Department reached the spot and brought the situation under control with the help of locals. Meanwhile, a senior officer of the district police called the chairman on Hotsup and requested him to settle the matter by night. Meanwhile, while he was consulting with the local dignitaries to settle the matter, on February 3, at 6:30 in the evening, Sarail Thana police and members of the district intelligence department in multiple pickups and 5/7 motorcycles went to the spot Sitaharan Bazar and created a frightening situation and evacuated the local people. He started beating Mustafiz. At that time, after Mostafizur Rahman introduced himself as the UP Chairman, the 1st accused Inspector Shehabur Rahman and the 2nd accused Deputy Inspector Zainal Abedin abused him in unspeakable language and said that if there is a dispute in the area, the chairman settles it through arbitration. He was beaten up by the accused’s Elopathari who said that he would not allow any case to be filed in the police station. At that time, 5 people including former UP members were arrested and brought to the police station and the next day they were sent to the court under section 151 of the Criminal Procedure Code.

Meanwhile Panishwar Union panel chairman Md Tauhid Mia and UP member Iman Ali along with CNGO rescued the chairman from the upazila chairman’s official residence and took him to his district town residence. He claimed that he did not go to the hospital on the day of the incident and took treatment at home. The day after the incident, on February 4, he made a written complaint to the Superintendent of Police Bararab. Since the office of the Superintendent of Police did not accept his complaint in writing, he sent the complaint again to the Superintendent of Police by post on February 7. In the case, he also mentioned that despite receiving a written complaint to the DI of Chittagong Police, Superintendent of Police of Brahmanbaria, Deputy Commissioner, Upazila Executive Officer, Officer-in-Charge of Sarail Police Station, he was forced to file a case in court. UP Chairman Mostafizur Rahman requested a judicial inquiry into the case. Aslam Hossain, the officer-in-charge of Sarail Police Station, was unable to contact the accused Sarail Police Station Inspector Md. Shehabur Rahman to speak to him. The local UP chairman was also arrested along with some local chieftains. There was no incident of physical torture to the chairman. Later, the upazila chairman, the upazila executive officer tried several times to make a respectful decision on the matter. Apart from this, the Chairman also made a written complaint to the Superintendent of Police, which is under investigation.
